Terms of Service

By accessing or using TopBlock (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

TopBlock is a writing tool that helps users draft U.S. Army evaluations using artificial intelligence. The Service is provided as an independent product and is not affiliated with, endorsed by, or sponsored by the United States Army or the Department of Defense.

You must be at least 18 years old to use the Service. By using the Service you represent that you meet this requirement and that you have the authority to enter into these Terms.

Subject to your compliance with these Terms, TopBlock grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal or professional evaluation drafting purposes.

You agree that you will not:

• Submit classified information, controlled unclassified information (CUI), or any other information you are not authorized to share with a commercial cloud service.
• Submit personally identifiable information about third parties that you are not authorized to share.
• Use the Service to generate content that is fraudulent, misleading, or that misrepresents another person's performance.
• Reverse-engineer, scrape, or attempt to access the Service in a way that bypasses the user interface.
• Use the Service to violate any law, regulation, or military policy applicable to you.

You are solely responsible for the content you submit to the Service and for any evaluation you ultimately sign or submit. The Service is a drafting aid; you and your chain of command remain fully responsible for the final evaluation in accordance with AR 623-3.

The Service, including its design, code, copy, and underlying technology, is owned by TopBlock. The text you input and the output the Service generates for you ("Generated Content") belong to you. TopBlock claims no ownership over your inputs or Generated Content.

You grant TopBlock the limited right to process your inputs and produce Generated Content for you. You also grant TopBlock the right to retain anonymized, aggregated metadata about service usage to operate and improve the Service.

Generated Content is produced by a third-party large language model. It may contain inaccuracies, omissions, or text that does not meet the requirements of AR 623-3 or your command's policies. You are responsible for reviewing and editing all Generated Content before using it in any official capacity. TopBlock makes no warranty as to the accuracy, regulatory compliance, or fitness for purpose of any Generated Content.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. TOPBLOCK DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL TOPBLOCK BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR CAREER OPPORTUNITY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF TOPBLOCK HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TOPBLOCK'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE IS LIMITED TO ONE HUNDRED U.S. DOLLARS ($100).

You agree to defend, indemnify, and hold harmless TopBlock and its operators from and against any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Service or your violation of these Terms, including any submission of content you were not authorized to share.

TopBlock may suspend or terminate your access to the Service at any time, with or without notice, for any reason. Upon termination, the license granted in Section 4 immediately ends. Sections that by their nature should survive termination (including disclaimers, limitations of liability, indemnification, and governing law) will survive.

TopBlock may modify the Service or these Terms at any time. Material changes to these Terms will be reflected in the effective date at the top of this page. Continued use of the Service after changes constitutes acceptance of the updated Terms.

These Terms are governed by the laws of the State of Michigan, without regard to its conflict of laws provisions. Any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Michigan, and you consent to the jurisdiction of those courts.

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
